Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to June 3, 2008 Law No. 17/2008/ QH12 on Promulgation of Legal
Documents;
Pursuant to November 13, 2008 Law No. 21/2008/QH12 on High Technology;
Pursuant to the Prime Minister's Decision No. 49^10/QD-TTg of July 19, 2010,
approving the List of high technologies prioritized for development
investment and the List of 1m-tech products encouraged for development; At the
proposal of the Minister of Industry and Trade,
DECIDES:
Article 1. Scope of regulation and subjects of application 1. Scope of regulation
This Decision provides policies to encourage development of the supporting
industries of manufacturing mechanical engineering, electronics-informatics,
manufacture and assembly of automobiles, textile and garment, leather-footwear
and hi-tech industry development. 2. Subjects of application
a/ State management agencies, organizations and individuals related to supporting
industries;
b/ Projects to manufacture supporting industry products. Article 2. Interpretation
of terms
In this Decision, the terms below shall be construed as follows: 1. Supporting
industry means an industry that manufactures materials, spare parts, details,
accessories and semi-finished products for supplying to industries that
manufacture and assemble finished products for use as production materials or
consumer goods.
2. Supporting industry products means products of industries specified in
Clause 1, Article 1, including domestically made materials, spare parts, details,
accessories and semi-finished products for supplying to the stage of assembling
and manufacturing finished products.
3. Project to manufacture supporting industry products means an investment
project in Vietnam (including new and additional investments) to manufacture
supporting industry products. Article 3. Promotion of development of supporting
industries
1. The State encourages and creates conditions for domestic and foreign
organizations and individuals to invest in developing supporting industries. 2.
Market development promotion
a/ Projects to manufacture supporting industry products may have their products
be advertised and introduced free of charge on the websites of the
Ministry of Industry and Trade and provincial-level Industry and Trade
Departments;
b/ Projects to manufacture supporting industry products shall be prioritized for
receiving funds from trade and investment promotion programs according to
regulations on formulation, management and implementation of these programs;
c/ Investors of projects to manufacture supporting industry products for
developing hi-tech industries shall be created opportunities by the State to
form product and service supply networks in accordance with the law on high
technology.
3. Infrastructure-related promotion
a/ Projects to manufacture supporting industry products shall be prioritized for
support and allocation of land areas of suitable area, location and rent rate;
b/ Projects to manufacture supporting industry products using land in industrial
parks and clusters may use infrastructure works and public and other services
therein; receive assistance and be given opportunities in labor recruitment and
training and enjoy other support policies under the Prime Minister's Decision
No. 105/2009/QD-TTg of August 19, 2009, promulgating the Regulation on
management of industrial clusters; c/ Small- and medium-sized enterprises that are
investors of projects to manufacture supporting industry products are entitled to
incentive policies on production grounds under the Government's Decree No. 56/
2009/ND-CP of June 30, 2009, on development assistance for small and medium-
sized enterprises;
d/ Projects to manufacture supporting industry products for developing hi-tech
industries are entitled to incentive policies on land in accordance with the law on
high technology.
4. Promotion in science and technology and human resource training
a/ Projects to manufacture supporting industry products shall be considered and
supported by the national scientific and technological development fund and other
funds related to scientific and technological activities to cover part of expenses
for technology transfer, purchase of design copyright, purchase of software and
hire of foreign expert. b/ Small- and medium-sized enterprises that are investors
of projects to manufacture supporting industry products may enjoy policies to
encourage raising of technologic capacity, technical levels and policies to support
human resource development under the Government's Decree No. 56/2009/
ND-CP of June 30, 2009, on development support for small- arid medium-sized
enterprises;
c/ Projects to manufacture (Supporting industry products shall be considered for
receiving funds from the state budget to cover part of expenses for human resource
training under current regulations; d/ Projects to manufacture Supporting industry
products for developing hi-tech industries may enjoy policies to encourage
human resource development in accordance with the law on high technology. 5.
Information provision
a/ Ministries, branches and People's Committees of provinces and centrally
run cities shall, through their e-portals provide updated information on legal
documents concerning development of supporting industries and technical
assistance programs of the State for projects to manufacture supporting industry
products;
b/ Small- and medium-sized enterprises that are investors of projects to
manufacture supporting industry products are entitled to' policies on provision of
information and consultancy under the Government's Decree No. 56/20097ND-CP
of June 30, 2009, on development support for small and medium-sized enterprises.
6. Finance
a/ Projects to manufacture supporting industry products are entitled to import and
export duty incentives under the current law on import duty and export duty;
b/ Projects to manufacture supporting industry-products may be considered for
borrowing state development investment credits under current regulations;
